My second bedroom is built above the garage and even with thermostat set above 74 that room records temps as low as the 50s because cold air coming up from garage. The builder sats there is nothing more he can do but I feel entitled to some compensation if he truly cannot do anything to insulate my house further. I think he could if he built a lower ceiling in garage and added insulation between the current ceiling and the lower ceiling.
Is this a new or existing house? if it is a newly built home then it is up to the company that built the house if it is an existing one then you have to find a contractor to do the work.
You shouldn’t need a lawyer though if it is still under warranty then call them up and raise h*ll that should get it taken care of.

I would be concerned about the heating supply ducts and returns. Probably this area is located at some distance from the furnace and the air is not circulated quickly enough. Consider adding a baseboard heater for more warmth,,cooling is another issue.
